In the case of Young v. Monsanto, a Philadelphia jury determined that Roundup is defective, but it was not the cause of Ryan Young’s non-Hodgkin’s lymphoma.

5. Cancer Warning on Roundup Label Not Required
Roundup Cancer Lawsuit Update | August 15, 2024
The 3rd Circuit Court of Appeals in Philadelphia ruled that Monsanto is not required to add cancer warnings to Roundup labels. The court agreed with Monsanto’s argument that federal law, which regulates pesticide labels, overrides state requirements.
This ruling conflicts with other appeals courts throughout the country, where judges have found that states can require additional warning requirements beyond federal regulations.
6. Monsanto Verdict Overturned, Allowing for a New Trial

An Oregon appeals court overturned a previous trial win by Monsanto in favor of Larry Johnson, who developed non-Hodgkin's lymphoma after using Roundup for over 20 years.
During his initial trial, Johnson was denied the chance to present key evidence from Dr. Charles Benbrook, a former executive director of the National Academy of Sciences Board on Agriculture. Dr. Benbrook has criticized the Environmental Protection Agency’s findings on the safety of glyphosate.
The appellate judges found that excluding information about the research used by the EPA to support their stance on glyphosate was a mistake. This decision could allow Johnson to seek a new trial against Monsanto.
7. Bayer Asks Congress for Protection from Roundup Lawsuits

In November 2023, a Missouri jury awarded $1.56 Billion to three victims who claimed Roundup caused them to develop non-Hodgkin’s lymphoma. The wife of one victim was also awarded $100,000 for suffering caused by her husband’s diagnosis.
Bayer later appealed this verdict, and a judge reduced the amount to $611 Million. The judge upheld the original $61.1 Million awarded in compensatory damages but slashed punitive damages, which are meant to punish the company for their wrongdoing, from $1.5 Billion to $549.9 Million.

9. Mistrial Declared in Roundup Wrongful Death Lawsuit

In Delaware, a Roundup wrongful death lawsuit resulted in a mistrial after the jury was unable to reach a unanimous decision. Members of the jury deliberated for three days before announcing they were deadlocked.
The lawsuit was brought by the family of Anthony Cloud, a landscaper who passed away from non-Hodgkin’s lymphoma in 2021. His loved ones were seeking $142 Million from Monsanto for failing to warn about the risks associated with Roundup.
Cloud’s family will have the opportunity to pursue another lawsuit against Bayer and Monsanto in the future if they choose to do so.
10. Over 4,200 Lawsuits Consolidated in Roundup MDL
